There are steps that need to be taken to insure that your registered Trademark stays registered.  Trademarks can be maintained on a perpetual basis if you file the necessary information with the USPTO at the appropriate times.  Failure to execute these steps can and will result in the cancellation of your Trademark.

Sometime between the anniversary of the fifth (5th) and sixth (6th) years of your Trademark registration, you are required to file a Declaration of Use form with the USPTO.  This form is known as a Section 8 form.

Sometime between the anniversary of the ninth (9th) and tenth (10th) years of your Trademark registration, you are again required to file a Declaration of Continuous Use (Section 8) as well as a Request for Renewal (Section 9) forms with the USPTO.  These forms must be filed every ten (10) years thereafter to keep you Trademark in force.

There is one additional form which you may elect to file.  This is the Declaration of Incontestability (Section 15) form.  The file and acceptance by the USPTO renders your Trademark “bullet proof”, with the exception of a claim of fraud or abandonment of your Trademark by a third party. This form can be filed after the fifth (5th) anniversary of your Trademark registration.
