Search and Enforcement Services - Terms of Services and Conditions

The Product Protection Group, LLC provides services via our website at   www.productprotectiongroup.com.   The terms and conditions herein constitute an agreement between you (our customer) and the Property Protection Group, LLC for infringement search and enforcement services.

1. Information Content: The information on the Product Protection Group, LLC (PPG) website or provided by a PPG employee or its representative is complete and reliable.  However, there may be typographic, grammatical, pricing or other errors on it.  PPG has and will continue to make every reasonable effort to correct errors as they are determined.   We reserve the right to make any changes to the website as we see fit.  Any changes posted to the website will be deemed to be effective immediately.  If changes to prices occur, any services purchased prior to the price change will be honored until the service has been completed and/or time duration of the service has expired.  

2. You may terminate any service purchased from the Product Protection Group, LLC (PPG) at any time.  The termination will be deemed effective upon receipt of written notification of the termination by PPG.  A termination of service will be deemed as full satisfaction of the service purchased from PPG without a refund of fees received.

3.In the event of a dispute between the Product Protection Group, LLC (PPG) and its customers, the dispute shall be governed by the laws of the State of New Jersey.

4.You are responsible for the submission of accurate information when purchasing services from the Product Protection Group, LLC (PPG).  PPG will conduct its Search and Enforcement Services based on your submission of information.  You agree to hold PPG harmless in the event of loss or damages incurred due to the submission of the erroneous information.

5.You agree that you are appointing the Product Protection Group, LLC (PPG) as your authorized third party agent in performing the services purchased by you.

6.You agree that prior to the performance of any Search and/or Enforcement Services by the Product Protection Group, LLC, you must execute a Limited Power of Attorney provided by PPG. This power of attorney will be required by 3rd part websites such as EBay, Amazon, since we will be submitting DMCA takedown requests and or any other requests on your behalf.

7.You agree that if an Agent of yours or your company purchases or uses any of our services, you are bound by the terms and conditions herein.

8.The Product Protection Group, LLC (PPG) search services are provided on a best effort basis.  PPG cannot and does not guarantee that it will find any and every piece of Intellectual Property Infringement when conducting any of its search services.

9.The Product Protection Group, LLC (PPG) offers a Money Back Guarantee on its DMCA Takedown Notice Service.  The guarantee provides that should your DMCA Takedown Notice be denied by an Internet Service Provider or Hosting Site due to an error in the preparation, submission and administration of the Takedown Notice by PPG, you are entitled to a full refund of fee paid by you.  The refund of the fee shall be made within five (5) business days of the notice of denial and an agreement of fault by PPG.  Our recommendation of the submission of a Takedown notice does not guarantee acceptance of the notice by the Internet Service Provider or Hosting Site and is therefore not covered under the Money Back Guarantee.

10.The Product Protection Group has the right at its sole discretion to utilize third party law firms and attorneys to perform any Enforcement Services on your behalf.  

11.The Product Protection Group, LLC (PPG) obtains information from you necessary to provide the service(s) that you have purchased.   This information is used by PPG, its employees and representatives for two purposes only: (1) execute the services that you have purchased and (2) periodically contact you concerning activities at PPG. PPG will never disseminate your information without your permission unless compelled to by legal authorities.

12.You agree and warrant to the Product Protection Group, LLC (PPG) that you will use the information any information received from PPG in compliance with all laws, rules and regulations.  This information includes but is not limited to information contained on the PPG website, as well as any written or verbal information provided by PPG, its owners, employees and its representatives.  Therefore, you agree to indemnify, defend and hold harmless PPG, its owners, officers, employees and representatives from and against any and all claims, proceedings, damages, injuries, losses and costs, including but not limited to legal costs and expenses arising from a breach by you of the foregoing representations, warranties and covenants.  We reserve the right, at our sole discretion and expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you and you shall not in any event settle any matter without our prior written consent.
